Understandable. The detector alerts of potential fire. If there's no fire, don't call the FD.its a combo. Way back when they called the fire department (one of the roomates called 911) and the fire department was mad for them calling
If the detector is low in battery, replace the battery.
If the detector is defective, replace it. They cost $20 tops. If you really insist, bill it back to the landlord.
If someone can sign a lease, they can take care of an above-wall device without resorting to contract laws and legal disputes.
