Personal Consumer Issues • Rear ended, insurance doing the dance.

#1 rule: contact your own insurance. That's what you pay them for. Never work with -- or even communicate with -- the other party or their insurance company. Ever.

THIS is what your own insurance is *for*!
The "other insurer" is NEVER on your side. Never.
If they can use something you happen to say... against you? They will!

And your insurer should make at least an attempt to get the deductible, too. (Ours does, although they won't spend a lot of time/money on that, because they aren't responsible for the costs.)

When we had trouble with a deductible, we asked our insurer to "tell the other insurer that IF we don't have that amount within 10 days [this was after too much time already], we WILL turn this over to the state Insurance Commissioner's Office."
A check arrived promptly.
I mean, after all, there was no way the agency was going to find in *their* favor, given that their insured's car had plowed through our fence and wiped out a bunch of landscaping in addition to the fence!
No other vehicle was involved.
