It's legal so long as the healthier spouse is only covered by one healthcare plan - he can't be enrolled in an HDHP plan and a PPO plan at the same time. He's also not permitted to fund it at the family rate, only as an individual if he were the only one on the plan, so contributions would be cut in half to $4350 or so.
The children can be covered under both plans and the parent can make HSA contributions up to the family limit. The only requirement is that the parent remain "an eligible individual" for the entire year, and that the HDHP cover someone in addition to himself.
