I am unaware of a 25% and a 28% tax rate on Qualified Dividends and Long-Term Capital Gains. Of course, the thread title does NOT use ""Qualified" nor "Long-Term", so I am unclear whether you are also commenting on the tax rates for nonqualified dividends and short-term capital gains.

So even if one has nonqualified dividends and income in the 0% qualified dividend tax rate regime, those nonqualified dividends will not necessarily get a 0% rate.
