Personal Finance (Not Investing) • Funding an Able Account from a Special Needs Trust - A Tax Question

I inquired to find out what I need to do to make sure it doesn't because it will be more in the future. They couldn't answer beyond "it depends" and "you could send a copy of the trust".
My understanding is that this is essentially an accurate answer to your question, in that the trust needs to be carefully and correctly written (e.g., to ensure that the beneficiary has no control over distributions), and programs like Medicaid can ask to look at it. I would consider employing the lawyer who wrote your trust to deal with the Medicaid folks on this issue (or a different, more specialist lawyer if the author of your trust wasn't an expert).
