You can move it to an IRA.
The regulations are in place to protect the spouse from being financially damaged by the account owner, through not being made aware of withdrawals.
At least where our 403b plans have been, spousal consent is needed to move any money "out", even to an IRA.
In fact, there are two sections of the 403b. The more restricted one includes money (and returns) contributed by EmployER. The other, with far fewer restrictions, is from EmployEE contributions.
Moving money "out" of either requires spousal consent.
Also requiring spousal consent: Moving money from the restricted section of the 403b to the less restricted portion of the *same* 403b. This makes little sense to me, as both require the same spousal consent to move the money entirely out of the 403b.
Are you sure about moving money from the 403b to an IRA without spousal consent? Once the money is in an IRA, there's no required spousal consent, so how would the spouse's interest be protected?
